Terms of Use

1. Description of the Service

Artifact lets you:

• AI-generated artwork: Use credits to create AI-generated designs. Each AI artwork costs 750 credits. You receive 1 free AI revision per AI order; each additional AI revision costs 500 credits, subject to a revision limit shown in the App (typically up to 3 revisions in total per order). Credits are purchased in-app (Shop) as credit packs. New accounts may receive welcome credits, and the App may offer limited free daily generations, as described in the App from time to time.
• Human-made artwork: Order custom artwork created by Artifact's founder and designer, Olivier De Grandpré. Human-made artwork is priced at $99.99 CAD per piece (one-time payment, not credits), or as shown at checkout. Orders include a set number of included revisions; additional revisions for human-made orders can be purchased in-app for $24.99 CAD each (or as shown in the App).
• Save and share: Download and share your artwork in accordance with these Terms and our Privacy Policy.

We may change, suspend, or discontinue any part of the Services with reasonable notice where feasible.

2. Account and Registration

You must create an account to use certain features. Sign-in is available via Apple Sign In and Google Sign-In (through Auth0). You agree to provide accurate information and to keep your account secure. You are responsible for all activity under your account. You must be at least 12 years of age (or 13 where required by law, e.g. in the United States) to use the App.

4. Acceptable Use and Conduct

You agree not to:

• Use the App or Services for any illegal purpose or in violation of any law.
• Upload, submit, or request content that is infringing, defamatory, harassing, obscene, or otherwise objectionable.
• Attempt to gain unauthorized access to the App, our systems, or other users' accounts.
• Reverse engineer, decompile, or extract source code from the App except as permitted by law.
• Use automated means (bots, scrapers) to access the Services without our permission.
• Resell, sublicense, or commercially exploit credits or generated artwork in a manner that violates these Terms or our separate commercial terms.

We may suspend or terminate your account and access if you breach these Terms or for other reasons consistent with these Terms and applicable law.

5. Intellectual Property and Licences

• Our rights: The App, its design, branding, and our technology are owned by us or our licensors. You receive no ownership in them.
• Your content: You retain ownership of content you upload (e.g. references, feedback). You grant us a licence to use, store, and process that content as needed to provide the Services (e.g. generating artwork, fulfilling orders).
• Generated artwork: Subject to your payment and these Terms, we grant you a worldwide, non-exclusive licence to use, display, reproduce, and commercially exploit the artwork generated or delivered to you through the App (including for albums, merchandise, and promotional materials), provided you comply with these Terms. This licence does not transfer ownership of the App, our branding, or our underlying technology.

6. Disclaimers

• The App and Services are provided "as is" and "as available." We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
• AI-generated output may vary and may not meet your expectations. We are not liable for the creative content of AI-generated artwork except as stated in these Terms or required by law.
• Human-made artwork is produced by Artifact's founder (designer); delivery times and outcomes depend on designer availability and your instructions. We will use reasonable efforts to meet described standards.

7. Limitation of Liability

• To the maximum extent permitted by law, we (and our directors, employees, and agents) are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the App or Services.
• Our total liability for any claims arising from or related to these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or, for in-app purchases of credits, the amount you paid for those credits).
• Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the greatest extent permitted by law.

8. Refunds

• In-app purchases (credits, revisions): Refunds for purchases made through the App Store or Google Play are governed by Apple's or Google's refund policies. You must request refunds through the applicable store.
• Human-made artwork: Refund requests for human-made orders should be sent to us (see Contact below). We will consider them in good faith based on order status, our policy, and applicable law. Approved refunds may be processed to the original payment method or as we otherwise agree.

9. Termination

• You may stop using the App at any time.
• We may suspend or terminate your account or access to the Services for breach of these Terms, fraud, or other reasons we deem necessary.
• On termination, your right to use the App and Services ends. Provisions that by their nature should survive (e.g. intellectual property, disclaimers, limitation of liability, governing law) will survive.

10. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms in the App or on our website and update the "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the App.

11. General

• Entire agreement: These Terms (together with our Privacy Policy and any in-app terms we reference) constitute the entire agreement between you and us regarding the App and Services.
• Severability: If any part of these Terms is held invalid or unenforceable, the remaining parts remain in effect.
• Governing law: These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law rules. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
